1. Scope of Application
These terms and conditions (hereinafter referred to as “Terms”) apply to all sales and deliveries made by Mustafa Int Trade Sp z.o.o., NIP: 5223207717, based in Poland. By placing an order, the buyer agrees to these Terms. Any other terms, including the buyer’s, are excluded unless agreed in writing.
2. Orders and Payment
All transactions are B2B (Business-to-Business) and available only to verified HFC franchise partners.
Orders are payable either in advance or within 7 calendar days of delivery. Late payments will trigger automatic collection procedures, including legal steps and additional fees.
3. Prices and Invoicing
All prices listed are exclusive of VAT, unless explicitly stated otherwise. Prices may change at any time due to market fluctuations, taxation, or external conditions without prior notice.
4. Delivery and Acceptance
Goods are considered accepted upon receipt. Product details and allergen information are provided at the time of delivery. Mustafa Int Trade Sp z.o.o. is not liable for health or hygiene issues resulting from improper storage or use after delivery.
5. Returns and Complaints
We do not accept product returns.
Complaints regarding damage or incorrect delivery must be submitted in writing within 48 hours of receipt via email to Levering@hfcnederland.nl, including photographic evidence. Valid claims will be resolved by replacement or credit, at our discretion.
6. Refund Policy
As our operations are B2B and tailored for verified franchisees, we do not offer refunds once the order has been processed and shipped. Exceptions may apply only in cases of confirmed delivery errors.
7. Retention of Ownership
Goods remain the property of Mustafa Int Trade Sp z.o.o. until full payment has been received.
8. Force Majeure
We are not liable for delays or failure to fulfill obligations due to force majeure events, including but not limited to war, strikes, pandemics, transport issues, or supply shortages.
9. Limitation of Liability
Mustafa-int Trade is not responsible for indirect, incidental, or consequential damages.
In any case, liability is strictly limited to the value of the order in question.
10. Legal Jurisdiction
All agreements are subject to Polish law, and any disputes will be settled in the court of Rotterdam, Netherlands.
